Appeal and Complaint Hearing Rules

If there is a disagreement on the inspection results, Applicant has a right to appeal to the Inspection Authority. The appeal should be submitted in writing to the head of the Inspection Authority, outlining the essence of the dispute. Head of Inspection Authority appoints an Appeal Commission. Appeal Commission Chairman is an independent person who determines the membership of Appeal Commission consisting of at least 4 persons. The Commission may include representatives of parties interested, regulatory authorities, applicants, Inspection Authority employees. Appeal Commission membership is agreed with the parties involved.
 

The applicant provides all the information necessary for the appeal to be considered, and also requests the other conflicting party to provide information within the same period that confirms or explains the situation. The application as well as the incoming additional information is sent to all members of Appeal Commission. Appeals Commission considers the Application at meetings or by electronic.

The Commission’s tasks include:

• consideration of Application
• submitted materials examination
• parties and experts interview
• decision-making

Making a decision the Appeal Commission is obliged to be guided by objectivity and make a decision by a simple majority of votes. If at the meeting the votes are divided equally, the vote of the Chairman is decisive. Voting by electronic correspondence the decision is considered adopted if it is approved by a simple majority of the Commission members. According to the Commission work results, an Appeal Statement is drawn up that is signed by all the Commission members and approved by the Chairman and after that it should be sent to the Parties.
